Foreclosures and short sales
If your mortgage is in default, the bank may try to foreclose on the property, causing you to move out and lose the home to the bank, which sells the property to recoup the money it is owed on the mortgage. Foreclosure in New York State is a judicial process, meaning that the lender must go to court in order to foreclose. This process gives you time to stop the foreclosure and correct any default, and you may additionally have defenses to prevent a wrongful foreclosure. If you owe more than the house is worth, you might be tempted just to walk away from the home and let the bank foreclose on it. This is not always in your best interests, however.
